Vehicle Sales Terms and Conditions for Erwin Hymer Centre Travelworld
  1. Prices are quoted inclusive of value added tax, where applicable. VAT will be charged at the current rate at the date of invoice.
  2. If the cost of the goods as set out on the Order form increases between the date of the order and the estimated date of delivery due to manufacturer or VAT increase, we (Erwin Hymer Centre – Travelworld) will notify you (the Purchaser) of the increase. This applies to new vehicles only.
  3. Where the agreement is for the purchase of goods to be ordered from any Manufacturer (e.g. built to order), Erwin Hymer Centre- Travelworld will provide you with an estimated delivery date. We will use our best endeavours to deliver by the estimated date but cannot guarantee this nor guarantee any time of delivery. If there are delays incurred due to external factors which are beyond Travelworld’s control, Travelworld shall not be held liable for any loss or damage which results from any such delay, whether financial or non- financial loss, direct or indirect loss, incurred by you.
  4. In the event of the Manufacturer ceasing to make a vehicle of the type ordered by you, Travelworld will endeavour to provide another satisfactory vehicle to your specification However, Travelworld will not be held liable for any delays resulting from this, whether financial or non – financial loss, direct or indirect loss incurred by you the Purchaser.
  5. Where we agree to allow part of the purchase price to be satisfied by you delivering a used vehicle in part exchange, the used vehicle shall be delivered to and accepted by us subject to the following conditions:
    (a) that the used vehicle will be delivered to us in the same condition as described by you at the time of the order (subject only to fair wear and tear);
    (b) that any quoted / estimated part exchange value for the used vehicle will only be confirmed upon physical inspection by us at the time of us taking delivery of the vehicle; and
    (c) in certain circumstances, it will be a requirement that the part exchange vehicle is included within that contract. You must seek permission prior if you wish to sell privately.
    (d) you accept that the used vehicle is your absolute property and free from any Hire Purchase Agreement or other legal encumbrance whatsoever and if this transpires to not be the case at any stage, Travelworld will have recourse to refuse to accept the used vehicle as part of the part exchange and withdraw from the agreement.
    (e) the used vehicle is the subject of a Hire Purchase agreement or Credit Sale agreement, and any outstanding finance is capable of being settled by us.
    (f) the part exchange is subject to a full inspection and HPI check on arrival to Travelworld.
  1. In the event of a used vehicle being taken in early part exchange, we may proceed to dispose of it before delivery of the goods.
  2. You will pay us the balance of the purchase price of the goods before delivery. Once you have paid us in full for the goods, we will give you 14 days in which to take delivery, but if you fail to do so, we will dispose of the goods and will recover our reasonable losses before issuing the proceeds of the sale to you. Delivery will not take place before the date indicated on the order form unless an earlier delivery date is agreed.
  3. Any notice to be given under this agreement shall be deemed to have been duly served if sent by Recorded Delivery to your last known address in our possession and subsequently recorded as having been delivered.
  4. You should discuss with us any terms that you do not understand and check that all the information provided is accurate and correct, and that any special arrangements that may have been agreed during the sales process are included and detailed on the Order form, before signing this Agreement. On signing this Agreement, this becomes a binding contract between Erwin Hymer Centre Travelworld and the Purchaser and relevant contract, and Consumer Rights Law will apply. If in any doubt, you should seek independent legal advice before signing this Agreement.
  1. Nothing in these terms and conditions will affect your statutory rights relating to either faulty or misdescribed goods, or poor-quality services. For more information on these statutory rights contact a local authority Trading Standards Department or Citizens Advice Bureau.
  2. A larger deposit may be required for bespoke orders.
  3. When specifying a new factory build vehicle to your bespoke requirements, once we have submitted the order to the manufacturer, alteration to this may not be possible and if they are, can dramatically affect the delivery date. Travelworld will not be liable for any such delays as this would be a factor outside of our control and therefore, we will not be held liable for any loss, whether financial or non-financial, direct or indirect.
  4. If you cancel the vehicle within a month of the delivery date, prior to any deposits to be returned, the vehicle will need to be resold to an end user.
  5. The materials appearing on Travelworld’s website could include unintentional minor technical, typographical, or photographic errors. Travelworld may make changes to the materials contained on its web site at any time without notice.
